This Terms & Conditions (“Terms”), together with the Payments Policy and the Shop Refunds and Returns Policy, govern your use of the Turtle Travel Club (“TTC”), Leaps and Events, and other services offered by The Ripen Group, LLC dba Amelia And JP (“AAJP,” “we,” “us,” or “our”).

These Terms govern your use of our website, community platforms, Leaps, Events, and all related services.

By enrolling in and participating in any AAJP service, including by not limited to TTC, eCourses, Leaps, Events or Experiences, you signify that you have read, understand and agree to be bound by these Terms.

1. Website Use & Responsible Conduct

By accessing or using our website, community platforms, or any associated services, you agree to use them only for lawful purposes and in accordance with these Terms.

You agree that you will not:

  • Use the website or Services in violation of any applicable law or regulation;
  • Attempt to gain unauthorized access to any portion of the website, community platforms, accounts, systems, or networks;
  • Use automated systems, bots, scraping tools, or similar methods to access, copy, monitor, or collect data from the website without our prior written consent;
  • Interfere with or disrupt the operation, security, or functionality of the website or Services;
  • Impersonate any person or entity, or misrepresent your affiliation with any individual or organization;
  • Post or transmit content that is unlawful, defamatory, abusive, harassing, fraudulent, invasive of privacy, or otherwise objectionable;
  • Infringe upon the intellectual property or other rights of any third party.

We reserve the right, at our sole discretion, to investigate and take appropriate action against anyone who violates this section, including removing content, suspending or terminating access, and pursuing legal remedies where appropriate.

Account Responsibility

If you create an account or access community spaces, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information and to update such information as necessary.

We are not liable for any loss or damage arising from your failure to protect your account credentials.

User Content

If you post, upload, or share content through our website or community platforms, you remain the owner of your content. However, by submitting content, you grant us a worldwide, royalty-free, transferable, sublicensable license to host, store, display, reproduce, modify, adapt, and distribute such content in connection with the operation and promotion of our Services.

You represent and warrant that:

  • You own or have the necessary rights to share the content;
  • Your content does not violate any law or infringe upon the rights of any third party.

We may remove or restrict access to any content that we determine, in our sole discretion, violates these Terms or harms the integrity of our community.

2. Services

We provide access to a private membership community, global meetups, and loosely organized travel experiences (“Leaps”), which may include multi-week immersions, local and international gatherings, and special group experiences designed to foster connection, cultural exploration, and community engagement.

While we organize Leaps and Events, our primary service is the global community itself.

Community

TTC is a curated community of travelers interested in slow travel, moving abroad, cultural exploration, and meaningful connection. Admission is intended for individuals who align with the culture and values we foster.

Every Member shares responsibility for contributing positively to the community and for treating fellow Members, staff, hosts, and service providers with respect, in accordance with our Community Guidelines.

Scope of Services

Certain Leaps, Events, or Experiences may be subject to additional specific terms. In the event of a conflict between these Terms and the terms governing a particular Leap or Experience, the specific Leap or Experience terms will control.

We may introduce new features, services, or offerings from time to time. All such additions are subject to these Terms.

We reserve the right, in our sole discretion, to modify, suspend, limit, or discontinue any aspect of the Services at any time, with or without notice. This includes the right to change itineraries, locations, accommodations, or schedules due to weather, availability, safety considerations, operational needs, or circumstances beyond our control.

We will make reasonable efforts to communicate material changes in advance where practicable.

Payment and Confirmation

No Membership, Leap reservation, eCourse enrollment, or other Service is confirmed until the required fee or deposit has been received and a confirmation email has been issued.

Until written confirmation is received, your participation is not secured. You are advised not to make non-refundable travel arrangements prior to confirmation.

Failure to make required payments by applicable deadlines may result in cancellation of your participation and forfeiture of amounts paid, in accordance with the Payments Policy.

3. Eligibility

To become a Turtle Travel Club Member, you must be at least forty (40) years of age. Access to membership areas, community spaces, and participation in TTC Services is limited to individuals who meet this requirement. We may, in our sole discretion, grant exceptions on a case-by-case basis.

When applying for or maintaining Membership, you agree to provide accurate, current, and complete information, including valid contact details.

Providing false, misleading, or incomplete information may result in denial or termination of Membership and forfeiture of applicable fees or deposits.

Member Responsibility

As a Member, you are solely responsible for your conduct, decisions, and actions, including any charges you incur or damage you cause to property, individuals, or third parties.

You agree to comply with all applicable laws, regulations, and local requirements in any location where you participate in TTC activities, Leaps, or Experiences.

Engaging in illegal activity, whether during a TTC Experience or otherwise, may result in immediate suspension or termination of your Membership without refund.

AAJP is not responsible for any legal consequences, penalties, or liabilities arising from your failure to comply with applicable laws.

We reserve the right, in our sole discretion, to evaluate allegations of misconduct or illegal activity and to take appropriate action to protect the integrity of our community.

Revocation of Membership or TTC Leap Access

All Members and individuals who participate in a AAJP Experience, utilize any AAJP Service, or engage with the AAJP communities are required to comply with our Community Guidelines.

AAJP reserves the right, at its sole and absolute discretion, to decline to provide Services, deny admission to a Leap or Experience, remove any participant or guest from a Leap or Experience, and/or revoke any Membership or access to the community. This right may be exercised for any reason, including but not limited to violations of our Community Guidelines, in order to protect (i) the culture and community experience we are fostering and/or (ii) the comfort, convenience, safety, or perceived safety of other Members.

This right to removal or expulsion applies not only to conduct that occurs during a TTC Leap, Experience, Service or Event, but also to conduct that occurs outside of official AAJP activities if such conduct, in our sole judgment, negatively affects the community or violates our standards.

In the event of removal, expulsion, or revocation of Membership or access, you will not be entitled to any refund, whether full, partial, or prorated.

4. Health & Fitness Requirements

General Expectations

Turtle Travel Club is inclusive and welcomes individuals of diverse backgrounds and abilities. However, due to the nature of international travel, certain destinations and activities may involve physical demands, including but not limited to walking on uneven surfaces, navigating stairs, exposure to heat or cold, high elevations, or limited accessibility.

Some locations may also have limited access to medical facilities or emergency services.

You are responsible for determining whether a Leap or Experience is appropriate for your physical and mental condition.

Disclosure of Health Conditions

You agree to disclose in advance any medical condition, mobility limitation, dietary restriction, or ongoing treatment that could affect:

  • Your ability to participate safely, or
  • The comfort, safety, or experience of other Members.

Advance disclosure allows us to evaluate whether reasonable accommodations may be possible and whether participation is appropriate.

Failure to disclose relevant health information may result in modification or denial of participation.

Accessibility & Independent Participation

While we will make reasonable efforts to support Members with disabilities, we cannot guarantee that all accommodations, venues, or third-party services will be fully accessible.

All participants must be able to navigate the trip environment independently. If you require personal assistance, mobility support, or sighted guidance, you must arrange for and travel with a qualified assistant at your own expense.

If bringing an assistant, all applicable fees and accommodations costs must be paid. Hosts and other Members are not responsible for providing personal care, mobility support, or supervision.

If you are unable to meet these independence requirements and do not provide appropriate support, we may modify or limit your participation for the safety and well-being of the group.

Fitness Confirmation

By submitting a booking request or participating in a Leap or Event, you confirm that you are physically and medically able to travel under the conditions described and to participate without requiring assistance from AAJP or other Members.

5. Travel Insurance

All Members are encouraged to obtain health insurance and/or travel insurance for each Leap, Event or other Service the Member wishes to participate in.

The insurance should provide for coverage of trip cancelation, lost luggage, personal injury, accidents, medical expenses, airlifts, repatriation costs, and other medical expenses.

AAJP is not obligated to cover any costs on your behalf. In the event AAJP covers costs on your behalf, you agree to immediately reimburse AAJP.

6. Disclaimers, Limitations of Liability, and Waivers

Force Majeure

We are not liable for any delay, disruption, modification, or failure in the performance of Services resulting from circumstances beyond our reasonable control. These may include, but are not limited to:

  • Natural disasters, fires, floods, or extreme weather
  • War (declared or undeclared), terrorism, civil unrest, or labor disputes
  • Epidemics, pandemics, quarantines, government restrictions, or travel bans
  • Infrastructure failures or transportation disruptions
  • Safety concerns or other circumstances that render a Leap or Service impracticable

No refunds, credits, or compensation will be provided for changes or cancellations resulting from such events, except as expressly stated in our Payments Policy.

Your obligation to make required payments is not excused by a Force Majeure event affecting you.

No Warranties

To the fullest extent permitted by law, our Services are provided “as is” and “as available,” without warranties of any kind, express or implied. This includes, without limitation, warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted access.

We do not guarantee that any Service, Leap, Experience, website content, or community interaction will meet your expectations or be error-free, secure, or uninterrupted.

Voluntary Participation & Assumption of Risk

Participation in travel-related Services, Leaps, Events, and community activities involves inherent risks, including risks of injury, illness, property damage, travel disruption, and death.

By participating, you acknowledge that you do so voluntarily and at your own risk. You assume full responsibility for your decisions, conduct, safety, and well-being.

You release and agree not to hold liable The Ripen Group LLC dba Amelia And JP, Turtle Travel Club, and their owners, employees, contractors, affiliates, and agents (collectively, “AAJP Parties”) for claims arising from your participation, except to the extent prohibited by applicable law.

Independent Travel Status

TTC Leaps are community-based group travel experiences. We are not a travel agency or tour operator. Participants are responsible for arranging their own transportation, travel documentation, and insurance coverage.

We are not responsible for the acts or omissions of third-party vendors, lodging providers, transportation companies, or other service providers.

Limitation of Liability

To the fullest extent permitted by law, AAJP Parties shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost data, loss of goodwill, business interruption, personal injury, or wrongful death.

If we are found liable for any claim arising out of your use of the Services, our total liability shall not exceed the lesser of:

The total amount you paid to us in the six (6) months preceding the event giving rise to the claim; or

Five hundred U.S. dollars ($500 USD).

Scope & Legal Application

These disclaimers, waivers, and limitations apply to all claims, regardless of legal theory, including contract, negligence, tort, warranty, or statutory claims.

Some jurisdictions do not permit certain exclusions or limitations of liability. In such cases, our liability will be limited to the maximum extent permitted by applicable law.

7. User Content & Protection of Personal Information

Ownership and License

You retain ownership of any information, photographs, comments, feedback, posts, or other content you create or share through our website, community platforms, social media interactions, or Services (“Content”).

By submitting or sharing Content, you grant AAJP a worldwide, royalty-free, transferable, sublicensable, irrevocable license to host, store, reproduce, display, modify, adapt, publish, and distribute that Content in connection with operating, promoting, and improving our Services.

This license includes the right to use your name, image, likeness, voice, and any identifying information included within the Content.

This license survives termination of your Membership or this Agreement.

Community Content Standards

You represent and warrant that:

  • You own or have the necessary rights to share the Content;
  • Your Content does not violate any law or infringe the rights of any third party.

We reserve the right, at our sole discretion, to review, edit, remove, or require removal of any Content that we believe violates these Terms, infringes upon rights, or harms the integrity of our community or Services.

Photography, Video & Media Release

By participating in Leaps, Events, or other Services, you acknowledge that photographs, video recordings, and audio recordings (“Recordings”) may be created that include you.

You grant AAJP permission to use such Recordings, without compensation, for promotional, marketing, educational, and business purposes in any media format now known or later developed.

If you prefer not to appear in certain promotional materials, you may notify us in advance, and we will make reasonable efforts to accommodate your request where practical.

Personal Information

Our collection, use, and protection of your personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Electronic Communications Consent

By enrolling in an AAJP Membership or using any AAJP Services, you consent to receive communications from AAJP through the contact information you provide, including but not limited to emails, phone calls, text messages, and messaging applications.

These communications may include:

  • Membership updates
  • Service notifications
  • Leap and Experience details
  • Billing and payment notices
  • Community announcements
  • Marketing and promotional materials

You may opt out of receiving marketing and promotional communications at any time by following the unsubscribe instructions included in those communications or by contacting us directly.

However, you acknowledge that opting out of marketing communications does not exempt you from receiving essential communications related to your Membership, billing, service updates, or participation in TTC Leaps and Experiences.

You agree to indemnify, defend, and hold harmless AAJP, its owners, employees, contractors, and agents from any and all claims, liabilities, damages (actual and consequential), losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to your consent to receive such communications or your use of the provided contact information.

9. Intellectual Property & Confidential Information

Intellectual Property

All content, materials, and information made available through our website, community platforms, Leaps, Experiences, and Services, including text, graphics, logos, trademarks, service marks, software, designs, videos, course materials, and other proprietary content, are owned by AAJP or its licensors and are protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, license, sell, or otherwise use our content for commercial purposes without our prior written consent.

All rights, title, and interest in and to our Services and materials remain exclusively with AAJP and its licensors. Unauthorized use of our intellectual property is strictly prohibited.

Confidential Information

During your Membership or participation in our Services, you may have access to non-public information relating to our business operations, vendor relationships, community structure, member information, processes, pricing, or other proprietary matters (“Confidential Information”).

You agree not to copy, disclose, distribute, exploit, or use Confidential Information for any purpose other than your personal participation in the Services.

You further agree not to use such information to compete with, solicit from, interfere with, or otherwise harm AAJP, its Members, vendors, partners, or affiliates.

This confidentiality obligation survives termination of your Membership and this Agreement.

10. Payments, Cancellations & Refunds

All billing terms, cancellation policies, deposit structures, payment schedules, and refund eligibility are governed exclusively by our Payments Policy, which is incorporated into these Terms by reference.

By purchasing or reserving any Membership, Leap, Experience, or Service, you acknowledge that you have reviewed and agree to the applicable Payments Policy.

If a specific Leap or Experience includes additional payment terms, those terms will control in the event of a conflict.

11. Release

By using our Services or participating in any Membership, Leap, Event, Experience, or community activity, you release and discharge AAJP Parties from any and all claims, demands, liabilities, damages, losses, or expenses arising out of or related to your participation, except to the extent prohibited by applicable law.

This release includes claims arising from negligence to the fullest extent permitted by law.

You agree that you will not initiate or maintain any action or proceeding against the AAJP Parties for matters covered by this Release.

This Release survives termination of your Membership and this Agreement.

12. Indemnification

You agree to indemnify, defend (at our request), and hold harmless the AAJP Parties from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use or misuse of the Services;
  • Your participation in any Leap, Event, or Experience;
  • Your breach of these Terms or any incorporated policy;
  • Your violation of any applicable law or the rights of any third party;
  • Any claim brought by a third party arising from your conduct, actions, or omissions.

We reserve the right to assume control of the defense of any matter subject to indemnification, and you agree to cooperate fully in such defense. You may not settle any claim without our prior written consent.

This indemnification obligation survives termination of your Membership and this Agreement.

13. Governing Law & Dispute Resolution

Governing Law

These Terms and any dispute arising out of or relating to your Membership, participation in our Services, or use of our website or community platforms shall be governed by the laws of the State of Texas and applicable federal law, without regard to conflict of law principles.

Good Faith Resolution

Before initiating arbitration or legal proceedings, you agree to first attempt to resolve any dispute with us in good faith through written notice and direct negotiation.

If the dispute is not resolved within forty-five (45) days after written notice is provided, either party may proceed as set forth below.

Binding Arbitration

Any dispute not resolved through negotiation shall be submitted to final and binding arbitration conducted in Travis County, Texas, in accordance with the rules of the American Arbitration Association then in effect.

The arbitrator’s decision shall be final and binding and may be entered in any court of competent jurisdiction.

Waiver of Jury Trial & Class Actions

To the fullest extent permitted by law:

  • You waive any right to a trial by jury in connection with any dispute arising under these Terms; and
  • You agree that disputes shall be resolved individually and not as part of any class, consolidated, or representative action.

Attorneys’ Fees Limitation

If you initiate arbitration or legal proceedings without first attempting good faith negotiation as required above, you waive any right to recover attorneys’ fees, even if such recovery would otherwise be permitted.

14. Severability

If any provision of this Agreement is found to be unlawful, void, or unenforceable under applicable law, that provision shall be enforced to the maximum extent permissible and shall be deemed severed from this Agreement to the extent it is unenforceable.

The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

15. Miscellaneous

Modifications & Waivers

No modification, amendment, or waiver of any provision of this Agreement will be effective unless made in writing and signed by an authorized representative of AAJP.

A waiver of any provision or breach will not be deemed a waiver of any other provision or of the same provision at any other time.

Assignment

You may not assign, transfer, or delegate your Membership or any rights or obligations under this Agreement without our prior written consent.

Any attempted assignment without consent is void.

We may assign or transfer our rights and obligations under this Agreement at our discretion, including in connection with a business restructuring, sale, or transfer of assets.

Headings

Section headings are provided for convenience only and do not affect the interpretation of this Agreement.

Cooperation

You agree to provide reasonable cooperation and documentation upon request to confirm your compliance with this Agreement.

Electronic Agreement

You agree that this Agreement may be executed and accepted electronically. The absence of a physical signature does not affect the validity or enforceability of these Terms.

16. Statute of Limitations

Any claim, demand, dispute, or cause of action arising out of or relating to your use of our Services, this Agreement, or any incorporated policy, including claims subject to arbitration, must be initiated within one (1) year from the date the claim accrues.

Any claim not brought within this one-year period is permanently barred to the fullest extent permitted by law.

This limitation applies to all forms of dispute resolution, including litigation, arbitration, and administrative proceedings.

17. Changes to this Agreement

The most current version of these Terms & Conditions will always be available on our website.

AAJP reserves the right, at its sole discretion and without notice, to update, modify, or replace any part of this Agreement by posting the revised Terms on our site.

It is your responsibility to review the Terms periodically. Your continued use of AAJP Services after any changes are posted constitutes your acceptance of those changes.

18. Entire Agreement

These Terms & Conditions, along with any policies or operating rules posted by AAJP on our website or in connection with our Services, constitute the entire agreement and understanding between you and AAJP regarding your use of the Services.

This Agreement supersedes any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and AAJP (including, without limitation, any prior versions of the Terms & Conditions).

Any ambiguities in the interpretation of this Agreement shall not be interpreted against the drafting party.
